Terms of Service

FitBox is a meal-preparation and delivery service offering calorie-controlled, authentic Asian meals on a subscription basis. FitBox is a corporation incorporated in the Province of Ontario, Canada, and may be contacted at info@fitboxmeal.ca.

To create an account and enter into a subscription or purchase, the account and payment holder must be at least 18 years of age (the age of majority in Ontario). Where the account holder is under 18, a parent or guardian must agree to these Terms on the account holder's behalf and remain responsible for the account and for all payments. Meals may be consumed by members of the household of any age.

You are responsible for the accuracy of the information in your account (including delivery address, contact details, and any dietary or allergy information) and for keeping your login credentials secure. You are responsible for activity that occurs under your account.

Menus, plans, and prices are shown on the Service and may change from time to time. All prices are in Canadian dollars and exclusive of applicable taxes unless stated otherwise. Delivery fees, where applicable, are shown at checkout before you confirm payment.

When you place an order, you authorize us (through our payment processor) to charge your selected payment method for the order total, including taxes and any delivery fee. An order is confirmed when we accept it; we may decline or cancel an order (for example, where an item is unavailable, an address is outside our delivery area, or we suspect fraud), in which case we will not charge you, or will refund a charge already made.

Recurring subscriptions, billing timing, auto-renewal, price changes, skips, pauses, cancellation, and failed payments are governed by our Subscription Terms.

FitBox provides calorie and nutritional information and an allergen disclaimer with each meal. This information is provided in good faith for general guidance. While we take care in preparing meals, we cannot guarantee that any meal is free from a specific allergen, and our meals may be prepared in facilities that also handle common allergens.

Nutritional and calorie figures are estimates and may vary. The Service is not medical or dietary advice. If you have a food allergy, intolerance, medical condition, or are pregnant, consult a qualified professional before relying on our meals, and use your own judgment based on the allergen and ingredient information provided.

You agree not to misuse the Service, including by: providing false information; interfering with or attempting to gain unauthorized access to the Service or its systems; using the Service for any unlawful purpose; reselling meals or the Service without our written permission; or infringing our or others' rights.

The Service, including our brand, content, and software, is owned by FitBox or our licensors and is protected by law. We grant you a limited, personal, non-transferable licence to use the Service to browse and place orders. You may not copy, modify, or create derivative works from the Service without our permission.

The Service relies on third parties (for example, our payment processor and delivery couriers). Your use of those services may be subject to their terms, and we are not responsible for third-party services outside our control except as set out in our policies.

Except as required by applicable consumer-protection law, the Service is provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. Nothing in these Terms removes or limits any legal rights or warranties that cannot be excluded under applicable law, including the Ontario consumer-protection legislation.

To the fullest extent permitted by law, FitBox and its directors, officers, and employees will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service. Where we are found liable, our total liability for any claim relating to the Service is limited to the amount you paid to us for the order(s) giving rise to the claim in the three (3) months before the event. Nothing in this section limits liability that cannot be limited under applicable law (including for personal injury caused by our negligence, or under mandatory consumer-protection law).

You agree to indemnify and hold harmless FitBox from claims, losses, and expenses arising from your breach of these Terms or your misuse of the Service, except to the extent caused by us.

We may update the Service and these Terms from time to time. If we make material changes, we will take reasonable steps to notify you (for example, by email or a notice on the Service). Changes take effect when posted, or as stated in the notice. Your continued use of the Service after changes take effect means you accept the updated Terms. For changes to recurring subscriptions and pricing, the notice provisions in our Subscription Terms apply.

You may stop using the Service and cancel your subscription at any time as described in the Subscription Terms. We may suspend or terminate your access if you breach these Terms or where required to protect the Service, other users, or to comply with law.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there. You agree to the exclusive jurisdiction of the courts located in Ontario, subject to any right you have to bring a claim or complaint in your home jurisdiction under applicable consumer-protection law.
